Food & Wine Tours – Terms & Conditions – Waiver Notice

By purchasing a ticket(s) from The Treasure Coast Foodie for a food & wine tour, means you have read, understood, and agree to our Terms & Conditions and our Waiver & Release of Claims as written below:

Day-Of / Check-In: We ask that you arrive 5 – 10 minutes early to allow ample time to check-in. We meet at the first location, so there will be a little flexibility with your arrival time, but we have a schedule to keep for those who did show up on time and the restaurants that we visit.

Late Arrival: As stated above, we have a schedule to keep, and we will not wait for you when we depart to the second location. Because we are walking to all remaining locations, if you don’t make it before we depart, you have the option to catch up with the tour and walk to the next and all remaining locations to meet up with the group. Please contact your tour guide via text with the phone number provided in the email you received with the tour schedule.

Number of People Required to Conduct a Tour: Our tours require a minimum of 6 participants to conduct the tour If a tour date doesn’t sell out, we will propose an alternate date to allow us time to sell additional tickets and fill all remaining spots. If you are unable to make the tour on an alternate date, we will offer you a refund, minus 6% because we are still charged a credit card fee.

Refunds:  We do not offer refunds or rescheduling to another date for tickets purchased for our tours. Once purchased, that guarantees your spot, and we make arrangements with the restaurants for a set number of guests and food & wine to prepare. Your ticket(s) are transferrable to a third party.

Dietary Restrictions: We are unable to accommodate any food allergies or other dietary restrictions on our tours. Please note that foods served on our tours are at the sole discretion of the restaurants and may contain milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, gluten, and soy.

Weather: Our tours run rain or shine. Please check the weather and plan appropriately.

Media Rights: You agree to grant The Treasure Coast Foodie an irrevocable royalty-free license to use photos and videos taken on its food tours in which you may appear. The Treasure Coast Foodie has the right to reproduce, distribute, broadcast, exhibit, edit, digitize, or in any other way use the material by any means and in any form of media, whether existing now or created later, without restriction, by incorporating the material into its website, catalogs, books, brochures, magazines or any other publications, or any informational, commercial, promotional or advertising material. You agree that The Treasure Coast Foodie is and shall be the exclusive owner of all title, rights, and interest in the material and works, including the copyright thereof.

Waiver Notice

The participant chooses to take part in the food and drink on our Foodie Tour provided by The Treasure Coast Foodie.

The participant is in reasonable health and is not otherwise limited by either minor or serious mental or physical injury, disability, or illness that could potentially render yourself susceptible to injury or further disability while participating in our food tour activity.

The participant fully understands and accepts every one of the risks associated with his/her participation in the foodie tour, without restriction and including but not restricted to exposure to inclement weather conditions, food born illness or unanticipated allergic reactions, injuries including those arising out of intoxication, clumsiness, inattention, motor vehicles, motor scooters, pedestrians, other participants, up to and including death.

Participation in the Food & Wine tours by The Treasure Coast Foodie is at the participant’s own sole risk, and hereby forever and unconditionally releases and holds harmless The Treasure Coast Foodie and any affiliated entities, owners, parent companies, subsidiaries, present and former employees, officers, members, managers, partners, contractors & sub-contractors, insurers, third party affiliates, ticket & payment processing parties, food vendors, restaurants, tour guides, shareholders, and directors of the foregoing without limitation The Treasure Coast Foodie, from any and all claims, actions, damages, liabilities, losses, costs and expenses in any way arising out of or resulting from your participation in our food & wine tours. Any claims, actions, and liabilities for death, injury, loss, or damage to the participant, to anyone else, or to any property, regardless of whether or not such injury, loss, or damage was caused by the negligence or willful conduct of The Treasure Coast Foodie or any of the released parties. On behalf of his/herself, and/or any person or entity acting through or on behalf of the participant, further agrees to defend and indemnify the released parties, and to hold the released parties harmless, from any and all liabilities, claims, actions, damages, expenses including, without limitation or exception attorney’s fees.

This waiver and release of claims encompasses the complete agreement and acknowledgment between the participant and the released parties, and determinates, cancels, and supersedes any previous agreement or understanding relative to the subject matter contained within. There are no depictions, agreements, assurances, guarantees, arrangements, or stipulations other than what is described above in this waiver notice and release of claims.
